Warranty
We, us, or our means ISW TRADING PTY LTD t/a Polyfilm (ACN 128 380 861) and our contact details are set out at the end of this warranty;
You, or your means the purchaser or the original end-user of the Goods;
Goods means the product or equipment supplied to you by us, pursuant to the Terms and Conditions.
This warranty is attached to and forms part of our Terms and Conditions. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
1. Warranty
1.1 We provide this Warranty to you in addition to any rights or remedies you have under the Australian Consumer Law or any other applicable law (Consumer Law Rights).
1.2 Subject to the terms of this Warranty, if during the first 5 years from the date of purchase of the Goods (Warranty Period) the Goods prove defective because they are cracked, faded, discoloured or faulty, we will resupply the Goods. Your Consumer Law Rights may extend beyond the Warranty Period.
1.3 If any materials required to facilitate any replacement pursuant to clause 1.2 are unavailable or no longer in production, or your model of Goods is no longer available or in production, we will use our best endeavours to use or provide an appropriate equivalent model.
1.4 If any Goods are faulty on arrival or where we have sent you the wrong item, we will provide replacement Goods.
2. Making a valid warranty claim
2.1 To claim the benefit of this Warranty, you must:
(a) notify us by email or phone (via (07) 3265 7135) as soon as you become aware that the Goods are defective and in any event, within 14 days of when you become aware that the Goods are defective with evidence of proof of purchase of your Goods from us and a description and photographs of the claimed defect;
(b) provide any other information reasonably required by us to assess your claim; and
(c) provide us with a reasonable opportunity to inspect and assess the returned Goods.
2.2 Where you return the Goods as part of a Warranty claim under this clause 2.1 and where we find the Goods are covered by this Warranty, we will refund the associated costs of you returning the product to us.
2.3 Where we accept your claim under this Warranty, clause 1.2 will apply.
3. When this warranty applies and when it does not
3.1 This Warranty does not cover any defect which is caused (or partly caused) or contributed to, by:
(a) any cracking, fading or discolouration caused by improper use or application of the Goods;
(b) an act or omission, accident, or negligence by you or any third party not engaged by us (including any third party installer of your Goods);
(c) your failure to follow any instructions or guidelines (including any manual) provided by us or the manufacturer in relation to your Goods or properly maintain your Goods in accordance with any of our instructions or guidelines;
(d) use of your Goods otherwise than for any application or use specified by us;
(e) continued use of your Goods (where such use is not reasonable) after any defect in your Goods becomes apparent or would have become apparent to a reasonably prudent person;
(f) your failure to notify us of any defect in your Goods within a reasonable period of time after you become aware of or ought to have reasonably become aware of the relevant defect;
(g) any reasonable wear and tear of your Goods;
(h) an act of God or force majeure event (including but not limited to war, riot, invasion, act of terrorism, contamination, earthquake, flood, fire, or other natural disaster, or any other event or circumstance beyond our or the manufacturer's reasonable control); or
(i) improper use, installation, repair, replacement, maintenance or alteration of the Goods by you.
4. Returns for change of mind
4.1 You must notify us within 7 days of receiving the Goods if you would like to exchange, replace or refund the Goods for reasons other than a defect covered under the Warranty. 4.2 We offer exchanges (subject to stock availability) and return of products for change of mind where we determine (at our absolute discretion):
(a) you have provided the proof of purchase; and
(b) the products are in their original condition and have not been used, damaged, tampered with, altered, installed or attempted to be installed.
4.3 Please choose your parts carefully and make sure you have your correct vehicle information. If you are unsure about which products you should purchase, please contact us using the contact details below.
4.4 Requests for exchange or return of Goods for a change of mind will be assessed on a case by case basis. We will not cover the costs of delivery or re-delivery for a change of mind return. The returned Goods may also be subject to a restocking fee. You must cover these costs yourself.
5. General
5.1 Terms and Conditions prevails: This Warranty is subject to the Terms and Conditions and in the event of any inconsistency or ambiguity between this Warranty and the Terms and Conditions, the Terms and Conditions will prevail.
5.2 This Warranty is only valid and enforceable in Australia and is governed by the laws of Queensland.
